Terms of Use

These Terms of Use ("Terms") govern your access to and use of Peak Journey, including our mobile app, website, public leaderboard, public proof pages, invite links, download pages, subscriptions, and related services (collectively, the "Service").
By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be at least 13 years old to use Peak Journey. If you are under the age of majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian.
You are responsible for your account, device, sign-in providers, and any activity under your account or local app identity. Keep your login credentials secure and notify us if you believe your account has been compromised. You may not impersonate another person, create misleading profile information, or use another person's account without permission.
2. The Service
Peak Journey helps you build and share verified habits. Features may include GPS runs, focus timers, pose-assisted exercise tracking, photo check-ins, proof receipts, local habit history, XP, streaks, badges, leaderboards, public share pages, referrals, subscriptions, and social sharing tools.
We may add, change, limit, suspend, or discontinue features at any time. We may also set usage limits, update scoring rules, adjust XP curves, change leaderboard windows, or alter verification logic to protect the integrity of the Service.
3. Health, Fitness, and Safety
Peak Journey is for general habit, wellness, training, and productivity support. It is not medical advice, diagnosis, treatment, physical therapy, emergency support, or a substitute for professional care. Always use your own judgment, follow applicable laws, and consult a qualified professional before starting or changing a fitness, health, diet, or wellness routine, especially if you have a medical condition, injury, disability, or other concern.
Do not use Peak Journey while driving, cycling in unsafe conditions, crossing roads without attention, operating machinery, or doing anything where distraction could cause harm. Stop any activity if you feel pain, dizziness, shortness of breath, or unsafe conditions.
4. Verification, Sensors, and Accuracy
Peak Journey uses device sensors and software estimates to support habit proof, including location, motion, timers, camera, and on-device pose analysis. These tools can be inaccurate, unavailable, interrupted, spoofed, or affected by device settings, environment, hardware, network, operating system behavior, and user movement.
Streaks, XP, leaderboards, proof labels, calorie estimates, distances, pace, rep counts, form scores, and other metrics are estimates for motivation and product experience. They are not guaranteed to be complete, accurate, fair, or suitable for medical, legal, employment, insurance, competition, or safety-critical use.
5. Your Content
"User Content" means information or material you submit, create, upload, save, sync, publish, or share through Peak Journey, including profile information, handles, avatars, photos, videos, proof media, check-ins, habit data, captions, messages to support, and public shares.
You keep ownership of your User Content. You grant Peak Journey a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, display, publish, adapt, transmit, and otherwise use your User Content as needed to operate, secure, support, improve, and provide the Service, including creating proof pages, leaderboards, invite pages, previews, thumbnails, backups, and synced records.
You represent that you have all rights and permissions needed for your User Content and that it does not violate law, these Terms, or anyone else's rights. Do not upload or share images, videos, or information about another person without any consent required by law.
6. Public Sharing
Peak Journey includes features designed to make progress visible. If you create or distribute a public proof page, public recap page, invite link, leaderboard profile, image, video, or social post, people who receive or find it may view, save, copy, screenshot, reshare, or misuse it. Share only content you are comfortable making visible.
We may remove or disable public content, leaderboard entries, handles, avatars, or share pages that violate these Terms, create risk, or undermine service integrity.
7. Acceptable Use
You agree not to:
- Use the Service for illegal, harmful, deceptive, abusive, harassing, hateful, explicit, or exploitative purposes.
- Upload or share content that infringes intellectual property, privacy, publicity, or other rights.
- Fake, manipulate, automate, spoof, or tamper with sessions, GPS, pose tracking, XP, streaks, referrals, subscriptions, proof, or leaderboard results.
- Reverse engineer, scrape, crawl, copy, resell, benchmark, or use the Service to build a competing product except where law expressly allows it.
- Interfere with security, rate limits, infrastructure, app store systems, Supabase, payment providers, or other users' experience.
- Upload malware or attempt unauthorized access to accounts, systems, data, or non-public APIs.
- Use the Service in a way that could injure you, other people, property, or public safety.
8. Subscriptions, Billing, and Refunds
Paid features may be offered as subscriptions or in-app purchases through Apple App Store, RevenueCat, or other payment providers. Prices, taxes, renewal terms, cancellation rules, free trials, and refunds are governed by the applicable app store or payment provider terms unless we state otherwise.
Subscriptions may renew automatically unless cancelled through the applicable app store before the renewal deadline. Deleting the app or your account does not automatically cancel a subscription. You are responsible for managing cancellation through Apple or the payment provider used for purchase.
9. Third-Party Services
The Service may depend on or link to third-party services, including app stores, Supabase, PostHog, Vercel, RevenueCat, Apple, Google, Expo, social apps, and device operating system features. We do not control third-party services and are not responsible for their content, availability, terms, policies, or actions.
10. Intellectual Property
Peak Journey, including our app, website, software, designs, logos, names, text, graphics, code, scoring systems, and other materials, is owned by us or our licensors and protected by intellectual property laws. Except for the limited right to use the Service under these Terms, we do not grant you any ownership or license to our intellectual property.
You may not copy, modify, distribute, sell, lease, sublicense, create derivative works from, or exploit the Service except as allowed by these Terms or applicable law.
11. Feedback
If you send feedback, ideas, or suggestions, you grant us the right to use them without restriction or compensation. We are not obligated to keep feedback confidential.
12. Suspension and Termination
You may stop using Peak Journey at any time. We may suspend, limit, or terminate access to the Service at any time if we believe you violated these Terms, created risk, infringed rights, misused the Service, or if we need to protect users, the Service, or our business.
After termination, provisions that by their nature should continue will continue, including ownership, content licenses, disclaimers, limitation of liability, dispute terms, and payment obligations incurred before termination.
13. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, safety, and uninterrupted operation.
We do not guarantee that Peak Journey will preserve every session, sync without error, calculate every metric accurately, detect every movement correctly, prevent cheating, maintain every streak, or be available at all times.
14. Limitation of Liability
To the maximum extent permitted by law, Peak Journey and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, personal injury, or device damage, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid to Peak Journey for the Service in the 12 months before the claim or USD $100.
15. Indemnity
You agree to defend, indemnify, and hold harmless Peak Journey and its owners, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of law or third-party rights.
16. Disputes and Governing Law
These Terms are governed by the laws of the State of Delaware, excluding conflict of law rules, unless the laws where you live require otherwise. Before filing a claim, you agree to contact us at support@peakjourney.app so we can try to resolve the issue informally.
Any dispute that cannot be resolved informally will be resolved in the state or federal courts located in Delaware, unless applicable law gives you the right to bring a claim elsewhere or requires another process. You and Peak Journey waive any right to a jury trial to the extent permitted by law.
17. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice through the app, website, email, or another method. Your continued use of the Service after updated Terms take effect means you accept the updated Terms.
